DISPUTE RESOLUTION

INDEMNIFICATION
You agree to indemnify, defend and hold harmless Beauty Me MD, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims, including reasonable attorneys' fees, payable to any third party due to or arising out of (1) your breach of these Terms of Service or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services. 

We will notify you of any indefinable claim, provided that a failure to promptly notify will not relieve you of your obligations unless you are materially prejudiced. We may control the defense and settlement of such claim at your expense, including choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent (not to be unreasonably withheld). You will cooperate in the defense of indemnified claims, including by providing relevant documents.

SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

GOVERNING VENUE / WAIVER OF JURY TRIAL

Any legal action permitted outside of arbitration shall be brought exclusively in the state or federal courts located in Los Angeles County, California.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOTH PARTIES WAIVE THE RIGHT TO A TRIAL BY JURY IN ANY LEGAL PROCEEDING ARISING OUT OF OR RELATED TO THESE TERMS OR THE USE OF THIS WEBSITE.

CANCELLATION POLICY

Beauty Me MD maintains a 24-hour cancellation policy. If you need to cancel or reschedule an appointment, please provide at least 24 hours' notice so that we may offer the appointment time to another patient. Failure to provide proper notice or failure to attend a scheduled appointment may result in forfeiture of prepaid services or applicable cancellation fees of $50 or more subject to the treatment.

RETURN POLICY

No refunds are provided for products, service packages, memberships, or prepaid treatments once purchased. If you are unable to use an unrendered prepaid service, Beauty Me MD may, at its sole discretion, issue a credit for the prorated value of unused treatments, which may be applied toward other services or products offered by Beauty Me MD. Unopened retail products may be exchanged within seven (7) days of purchase.

TREATMENT OUTCOMES

Beauty Me MD is committed to providing high-quality care and aesthetic services. However, aesthetic medicine is not an exact science, and individual results vary. No guarantees, warranties, or assurances can be made regarding treatment outcomes. Payments are for services rendered and not for specific results. We strive to achieve the best possible outcome for every patient.

REVISION TREATMENTS OR TREATMENT OF COMPLICATIONS

The practice of medicine and aesthetics is not an exact science. While positive outcomes are anticipated, there can be no guarantee of specific results. Additional treatments or treatment of complications may occasionally be necessary and may result in additional charges for which the patient is responsible.

GRATUITY POLICY

Beauty Me MD is a non-tipping facility. The greatest compliment we can receive is your continued trust, referrals, and repeat business.

Beauty Me MD reserves the right to modify policies, pricing, services, promotions, and terms at any time without prior notice.

PRACTICE-PATIENT RELATIONSHIP

We value every patient relationship. However, Beauty Me MD reserves the right to refuse or discontinue services at any time, to any individual, for any lawful reason.

PRODUCTS AND SERVICES

Certain products and treatments, including but not limited to Botox®, Juvederm®, Restylane®, Kysse®, Contour®, and other specialty products, may be subject to additional costs. Pricing, promotions, rebates, and manufacturer incentives are subject to change without notice. Final patient pricing may reflect applicable vendor promotions, rebates, loyalty rewards, or discounts.

We have made every effort to provide an accurate representation of our products and services in our online stores. However, please note that colors or product appearance may differ from how they may appear on your screen due to the type of device you use to access the store and your device settings and configuration. 
We do not warrant that the appearance or quality of any products or services purchased by you will meet your expectations or be the same as depicted or rendered in our online stores.
